Personal Injury Lawyer for Car Accident Claims: Common Mistakes
In a recent case in the WA Courts a claimant was in a motor cycle accident and claimed over a million dollars in compensation. The Insurance Company valued his claim much lower and the claim failed to settle. Ultimately his claim went to trial. After hearing all the evidence the Court awarded him $2,200.
So what went wrong?
In reading the Court’s decision the Court seemed to find that the Claimant was not a reliable witness. The Court noted that the claimant had given too many different versions to different people as to how fast he was travelling at the time of his accident; there were numerous contradictions between what he said that he had told his doctor about his injuries and symptoms versus what the doctors had recorded in their notes; there was a contradiction between what he had told a doctor about his future work plans and what the doctor had recorded. The lesson is that you must be consistent: a Court will always look at the notes made by other, such as doctors treatment notes and reports and accident reports and claim forms. If you contradict those notes then you will need a good explanation.
